According to current legislation, training in Spain can be subsidized by companies by reducing their Social Security contributions and investing in improving their competitiveness and employability of their workers.

To do this, detailed requirements must be met that can be monitored for 4 years.

Requirements for bonuses

Training helps companies increase their competitiveness and productivity, developing the skills and qualifications of their employees. To do this, they have financial aid that is made effective through bonuses on Social Security contributions.

The company can decide what training it needs, how and when it is carried out, and organize it either by itself or by grouping with other companies, delegating all procedures to an organizing entity.

It includes the Individual Training Permits (PIF) that the company authorizes a worker to pursue studies with official accreditation, including degrees and professional certificates.

The bonus percentage could reach 100% (provided certain conditions are met). Otherwise, the entity should partially co-finance the action between 5 and 20% of the training action, for example in the participant's hours dedicated to training during their work day.

Nanfor Ibérica, accredited since 2008 as an organizing entity, can manage the administrative procedures that companies are required to undertake in order to have training credit as an added service.

We would like to highlight within the regulations that the documentation proving the costs must remain in the possession of the companies and only be made available to the competent control bodies if required.

Likewise, the obligations of the beneficiary companies are those established in article 5 of Order TAS/2307/2007, in addition to those provided for in other articles of the aforementioned order and those included in Royal Decree 395/2007, among others the following :

  • Identify in a separate account or specific heading in your accounting all the costs of carrying out training actions and individual training permits, as well as any bonuses that apply, under the name or heading of “vocational training for employment”.
  • Submit to the verification, monitoring and control actions carried out by the competent public administrations and other control bodies.
  • Safeguard the documentation accrediting the daily attendance of the participants to the training actions.
  • Guarantee the free training initiatives for their participants.
  • The company is up to date with its tax and Social Security obligations at the time the bonuses are applied.
  • For a minimum period of 4 years, companies must keep at the disposal of the competent control bodies the documentation justifying the training for which they have enjoyed discounts on Social Security contributions.

On the other hand, the organizing entity will be responsible for safeguarding the documentation related to the organization, management and delivery of the training actions in which it intervenes as the organizing entity. Without prejudice to the foregoing, companies will be directly responsible for the bonuses applied in their listing bulletins and for non-compliance with the obligations established in Order TAS/2307/2007, even when they are due to the actions of the entities with those that contract the provision of training or the entities organizing the training in the group of companies provided for in article 17 of the aforementioned order.

1. Calculate credit

To calculate your company's available credit, you must consult the data that appears in the Contribution Settlement Receipts entered (Base other contributions) from the previous year.

Average workforce: sum of number of workers (Contribution Settlement Receipts) divided by 12.

There is an additional credit for Individual Training Permits (PIF). Companies will be able to finance the salary costs corresponding to these permits with the annual training bonus credit and with the additional credit provided for in Royal Decree 395/2007.

2. Request Nanfor Ibérica to manage the administrative procedures for the bonus for the course offered via email to the consultant who sent the training proposal

3. Upon request for bonus management, Nanfor Ibérica will send the following information:

  1. Bonus guide.
  2. Training organization contract signed between companies under Law 30/2015, of September 9, which regulates the Vocational Training System for employment in the workplace.
  3. Document of adhesion to the contract for the organization of training signed between companies under Law 30/2015, of September 9, which regulates the Vocational Training System for employment in the workplace.
  4. Request for proposal for participation.
  5. Workers' Legal Representative Report Form. If there was.
  6. Certificate of Lack of Legal Representative of Workers. If it does not have.

NOTE: Even if the initiative comes from a company worker, Nanfor Ibérica will only begin the appropriate steps when a valid interlocutor from the company authorizes it (representative, HR or Training manager, etc...).

4. Inform the Legal Representation of Workers

Before the start of the courses, the company must present the following documentation to the RLT (*):

  • Name, description and objectives of the training actions.
  • Target groups and number of participants per training action.
  • Planned execution schedule.
  • Pedagogical means.
  • Criteria for selecting the participants.
  • Planned place of delivery.
  • Balance of the training actions of the previous year.

(*) When the company does not have RLT, the consent of the workers affected by the training actions will be necessary.

5. In order to start the subsidized training process, the company must send to Nanfor Ibérica:

a) Request for participation proposal, signed on both pages, first by scanned email to speed up the process to natalial@nanforiberica.com, and then the ORIGINAL by ordinary or certified mail.
b) Document of adhesion to the Entrustment Contract (2 COPIES signed and sealed by the legal representative of the company, first by scanned email to speed up the process to natalial@nanforiberica.com, and then the ORIGINALS by ordinary or certified mail), the which authorizes Nanfor Ibérica to carry out the procedures associated with subsidized training before the FTFE.
c) Report to the Legal Representation of Workers (RLT/Unions), signed on both pages, first by scanned email to speed up the process to natalial@nanforiberica.com, and then the ORIGINAL by ordinary or certified mail. (Essential document only if RLT exists). The person who manages the company's training will deliver the aforementioned documentation to the RLT, to inform them of the courses to be taken and to give their opinion (favorable/unfavorable/not expressed).
d) Certificate of lack of Legal Representative of Workers (RLT/Unions) signed, first by scanned email to speed up the process to natalial@nanforiberica.com, and then the ORIGINAL by ordinary or certified mail. (Essential document only if RLT does NOT exist).
e) Student registration form (as many copies will be completed as students want to enroll), first by scanned email to speed up the process to natalial@nanforiberica.com, and then the ORIGINAL by ordinary or certified mail. Along with this sheet, each student will deliver:

  1. Copy of the DNI of the legal representative of the company.
  2. Copy of the DNI of all enrolled students.
  3. Copy of the header of the last payroll of all enrolled students.

e) Bank receipt of the initial payment agreed with Nanfor Ibérica.

NOTE: These documents, essential to comply with the requirements of the FTFE, must be delivered to Nanfor Ibérica as soon as possible and at least 10 days before the start of the training.

6. Once this documentation has been received at Nanfor Ibérica, the process of management and delivery of training for your company begins:

Nanfor Ibérica informs the FTFE of the start of the course.

  • Communication must be made at least 7 calendar days in advance of the start date of each group; In the case of Individual Training Permits, communication before the start will be sufficient.
  • Dates, times, place of delivery, name and contents of the action, modality, number of participants and list of companies will be communicated (in the completion communication, a greater number of participants or companies other than those notified at the beginning will not be admitted). .
  • The cancellation of the group or the change of schedule, location or dates of teaching must be communicated 4 calendar days in advance of the scheduled start date.
  • If the change affects the start date, 7 calendar days must elapse between communication of the modification and the new start.
  • The rest of the changes will be sufficient to communicate them before the start of the course.

Nanfor Ibérica sends an email to the company with:

1.1. Copy of group start notification (for your information).

1.2. Documentation of the training action to be returned when the training ends.

1.3. Course payment invoice.

Nanfor Ibérica returns the ORIGINAL of the Document of Adhesion to the Entrustment Contract signed by the Legal Representative of our entity.

Nanfor Ibérica sends the teaching material and/or registration on the contracted course platform.

Aspects to consider in the development of training:

  • The duration of the course cannot be less than 2 hours.
  • A worker's participation may not exceed 8 hours per day.
  • The training must be free of charge for participants.
  • The company must keep the documents to control workers' daily attendance at the course.

Attendance control model - In-person.

  • In the case of training actions given under the teletraining modality, the platforms must make it possible to record the activity of the participants, said record acting as an attendance control.
  • The company, or where applicable, the teaching center must deliver, within a maximum period of 2 months from the date of completion, the certificate or diploma, and must retain documentary justification of its delivery or shipment.

7. The Company will obligatorily deliver the following documentation as soon as possible once the training action is completed:

  1. Evaluation questionnaire (to be filled out by each student and the ORIGINALS returned by ordinary or certified mail).
  2. Deliver diplomas (to be signed by each student and return the ORIGINAL by regular or certified mail).
  3. Deliver material (to be signed by each student and return the ORIGINAL by ordinary or certified mail).
  4. Control of attendance of in-person training (to be signed by each student and the trainer, and return the ORIGINAL by ordinary or certified mail).

8. Nanfor Ibérica, when providing the training, will carry out exhaustive monitoring of the student, to support them, from the beginning to the end of the course. Student Obligations

For the e-learning course to be creditable, the student must access all of the elements of the course during the time of access to the course. You will have to read and understand the concepts indicated in the course. For any questions or queries related to this, you must use the platform's internal email, so that there is a record of your participation. All communications must be made within the LMS and respond to the forums and activities related to the course.

Regarding access time, it is mandatory that the student register a minimum of 75% of the hours of the subsidized training action . For example, if the course says 115 hours, he has to be connected to the platform for a minimum of 87 hours.

Four weeks before the end of the course, the student must request information from support (soporte@nanforiberica.com) about times registered on the platform. To verify that you carry out the action correctly and have the bonus rights.

The participant must access all elements of the course , its tasks, activities, multimedia content, videos and URLs.

At the end of the training action, NanforIbérica issues a report on access time by course units, course elements, access dates, degree of progress, etc. that will be sent to the student and/or to the human resources department or to whoever has requested the course.

If these requirements are not met, the training action cannot be subsidized.

9. Once all the necessary documentation has been delivered and all timely payments have been made, Nanfor Ibérica notifies the FTFE of the completion of the group and the students in the relevant training action, informing of the costs and the month in which the company will proceed to apply the bonus. in their social insurance.

Said communication may be made from the end of the action, and in any case, before the presentation of the listing bulletin for the month of December. To carry out this step, the following will be completed in the application:

  • List of participants who have completed the training (completion of at least 75% of the course).
  • Course costs (training group): direct (directly related to the delivery) + indirect (limited to 10% of the total cost of the training activity) + organization costs (only in the case of entrusting the organization to an external entity, and limited to 10% of the cost of the training activity (15% in the case of companies with between 6 and 9 workers, and 20% in the case of companies with up to 5 workers).
  • Amount and month in which the bonus will be applied.

The application will calculate the maximum cost for which the company can receive a bonus, taking into account three amounts:

  • Credit available.
  • Costs incurred in the development of the training (taking into account the co-financing to which the company is obliged based on its workforce).
  • Maximum financeable amount in accordance with the applicable economic modules depending on the modality and level of training.

Companies with 1 to 5 workers are exempt from co-financing training with their own resources. Likewise, Individual Training Permits are excluded from the obligation of private co-financing.

Cost orientation for demand formation: training actions of companies

10. Nanfor Ibérica sends the company the group end notification detailing the amount so that the bonus can be applied.

The company may apply the bonus from the communication of the end of the group in the application, until the presentation of the bulletin for the month of December of the current year (The bonuses corresponding to the Individual Training Permits may be applied as they are paid wages to workers).

RED System

The amount of the bonus (completed in the telematics application) will be communicated in the EDTCA80 segment "SPEE continuing training bonus":

It will be accumulated in the segment EDTCA60 "Sum of bonuses, subsidies and compensations".

If the balance is creditable (the amount to be credited is higher than the company's contribution), the TGSS will proceed to reimburse it.

Once the exercise has ended, the Tripartita Foundation will verify the bonuses applied, as well as compliance with the requirements and obligations, including the result of the monitoring and control actions, if any.

Informative note : Nanfor Ibérica as a training entity is not responsible for the amounts that the company receives or for any claims that FUNDAE may make for amounts deducted due to the worker's non-attendance at the course, amounts deducted incorrectly or other causes that are not disclosed. arise from the non-implementation of the training action.

Causes such as non-attendance of the student, non-recognition of available credit from the company, partial justification of expenses of the company not recognized by FUNDAE and also any situation of a legal or regulatory nature by which the company is denied the bonus of its fees. of social security.

Due to the different contracting and acting parties, Nanfor Ibérica will not be able to guarantee that all training actions are subsidized.

BECAUSE NANFOR IBERICA HAS TWO RATES FOR COURSES DEPENDING ON WHETHER OR NOT THEY ARE SUBSIDIZED:

The rate applied to subsidized courses is not based on the administrative activities that must be carried out before FUNDAE; these services are provided by Nanfor free of charge for its e-learning courses. The difference is based on the added monitoring service per participant so that the daily evolution of each student is monitored, analyzing the bonus possibilities, seeing their passage through all the points, preparing a completion document with the access records and necessary times.
In addition, Nanfor must provide a set of resources of tutors, platform, access for inspections and other services that generate an addition to the level of open individualized support service.

On the other hand, through the teletraining bonus, the client receives 100% of the amounts used, something that does not happen in many cases with face-to-face training or tele-face-to-face training.
